Social Security Proof With Invoice?

I have an employer that is insisting that every month I bring a slip from my bank that proves that I pay my SS and attach it to my invoice. I am confused as to why (as I am autonomo) I have to prove anything to them concerning my person finance. I am responsible for my SS and they are not. Can they be held responsible for my Scocial Security, if I do not pay it?

They are also saying that they will with hold my next payment if I do not show payment of my taxes in april!?!?

Is this a legal demand?

It is a pain in the butt to go get the slip ever month. And, It is hard for me to belive they have the right to hold payment if they are not responsible for my Taxes and SS.

considering how many academies hire illegals i'm shocked to hear this.  i thought all taxes were optional here.  is this a teaching job?

Yes, For a private company, but the crazy thing is that they are breaking the law all over the place when it comes to spanish labor laws Not give the correct vacations, no maternity leave, etc...).

It is raro... I mean, it is only extra work for them, so i am confused.

Hi Killmon and benitacanova --

Just to clarify, taxes are not optional here in Spain. Either you are working legally or you are not. Legally working means that either you are paying your taxes as an autonomo or your employer is paying them on your behalf.

Regarding social security payments. If you are autonomo the company that has contracted you cannot be held responsible for paying your social security as long as the agreement you signed with them was in good faith. However, if you should get injured on the premise of a business while on the job and you don't have social security coverage, the company where you go to teach could be held responsible for paying your medical expenses.

While your hiring company cannot withhold your payment legally, unless it was stated otherwise in your agreement with them, they can make it a stipulation of working with them and terminate your agreement at will.

You ought to be glad to be working for this company as it is one that apparently takes working legally seriously. Remember that if you are in fact a bonafide autonomo, no one is responsible for your vacation time except for you... and there is no maternity leave for autonomos unless you pay a higher amount to social security. You are autonomo, self employed... no one is responsible for your expenses except for you.

BTW it could be that they company is requiring proof a payment from you because that is what their clients require. It's not the first time that I have heard of this.

lol, It must be fairly common for people to not pay; However, I am old and require the coverage, so I pay...hehe. Everything is optional as a given action. It is, however, the consequences that tend to make themselves non-optional (we usually don't have direct control of them).

I have found out that Taxes are private and SS in normally shown with the first invoice. However, if stipulated in your contract I suppose anything is close to legal. I have a verbal contract, so they can `can´ me at any point more or less. But it is difficult to get English teachers here (in the boone docks), so I am safe for now.

No Prablema! I really appreciate the site and the people. It is a great recourse and any place that can tolerate my crazy points of views is truly an advance race of people (notice I did not say, \"-agree with my crazy points of views-\"; that would make you crazy, lol).  :P
